1. Introduction
These Terms & Conditions ("Terms") govern your use of Aqana ("the Service", "we", "us", "our"), a personal finance management platform accessible via web and mobile applications at aqana.uk.
By creating an account or using Aqana, you agree to these Terms. If you do not agree, please do not use the Service.
2. Service Description
Aqana provides the following features:
- Account aggregation: view balances and transactions from multiple UK bank accounts in one place, via Open Banking (powered by TrueLayer)
- Manual finance tracking: add transactions, accounts, budgets, and categories manually
- Spending insights: automated categorisation, spending trends, and budget tracking
- AI assistant: conversational insights about your financial data
- Subscription tracking: detection and management of recurring payments
3. Eligibility
- You must be at least 18 years old to use Aqana
- You must be a resident of the United Kingdom
- You must provide accurate and complete information when registering
4. Your Account
- You are responsible for maintaining the confidentiality of your login credentials
- You must notify us immediately if you suspect unauthorised access to your account
- You are responsible for all activity that occurs under your account
- We reserve the right to suspend or terminate accounts that violate these Terms
5. Open Banking & Account Connections
When you connect a bank account via Open Banking:
- You authorise Aqana to access your account information, balances, and transaction history in read-only mode through TrueLayer, an FCA-authorised Account Information Service Provider (AISP)
- We cannot initiate payments, transfers, or any other financial transactions on your behalf
- Bank connections require your explicit consent and you can disconnect any bank at any time from Settings
- Open Banking consents typically expire after 90 days, at which point you will need to re-authorise the connection
- We are not responsible for any delays, errors, or outages caused by your bank or TrueLayer's services
6. Data & Privacy
Your use of Aqana is also governed by our Privacy Policy, which explains what data we collect, how we use it, and your rights. By using the Service, you acknowledge that you have read and understood the Privacy Policy.
7. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any applicable law
- Attempt to gain unauthorised access to the Service, other user accounts, or our systems
- Use the Service to launder money or facilitate financial crime
- Reverse-engineer, decompile, or disassemble any part of the Service
- Use automated scripts, bots, or scraping tools to access the Service
- Impersonate another person or misrepresent your identity
8. Financial Information Disclaimer
Aqana is a personal finance tracking tool, not a financial adviser.
- The information displayed in Aqana (balances, spending summaries, insights, AI suggestions) is for informational purposes only and does not constitute financial advice
- We do not guarantee the accuracy, completeness, or timeliness of data received from your bank via Open Banking
- AI-generated insights are based on your transaction data and may not account for your full financial situation
- You should not make financial decisions based solely on information from Aqana without consulting a qualified financial adviser
- We are not responsible for any financial loss resulting from reliance on information displayed in the Service
9. Service Availability
- We aim to keep Aqana available at all times but do not guarantee uninterrupted access
- We may suspend the Service temporarily for maintenance, updates, or security reasons
- Third-party services (Open Banking providers, bank APIs) may experience outages outside our control
10. Intellectual Property
All content, design, code, and branding associated with Aqana are owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written consent.
11. Limitation of Liability
To the fullest extent permitted by law:
- Aqana is provided "as is" and "as available" without warranties of any kind, express or implied
- We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service
- Our total liability for any claim arising from or related to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim (or £50, whichever is greater)
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law
12. Termination
- You may close your account at any time from the Settings page
- Upon account closure, we will delete your personal data in accordance with our Privacy Policy
- We may suspend or terminate your account if you breach these Terms, with notice where reasonably practicable
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
